1. (1) Written Consent Required. Written consent for a voluntary transfer is required. Consent must be in writing on the form provided by the Division on the back page of the brochure, “Leaving the Nursing Facility.” If a resident has substantially impaired cognitive powers, consent may only be given by a person designated by the resident to receive notice or, if none, the resident’s legal representative.

2. (2) Documentation. The completed consent form must be kept in the resident’s clinical record.
