The owner of gasoline at any gasoline terminal, distributor or retail outlet (defined in OAR 340-258-0010) shall not supply gasoline to any oxygenated gasoline control area during the control period (defined in 340-258-0010) without an approved Indirect Source Operating Permit issued by the Department or Regional Authority having jurisdiction:

1. (1) An Indirect Source Operating Permit must be renewed yearly, prior to supplying any gasoline to an oxygenated gasoline control area during the control period.

2. (2) Persons applying for an Indirect Source Operating Permit shall at the time of application pay the following fees:

   1. (a) Gasoline Terminals — $2,500;
   2. (b) Gasoline Distributors — $250.
