1. (1) Class I:

   1. (a) Failing to register or participate in a producer responsibility organization;
   2. (b) Failing to substantially implement a producer responsibility program plan;
   3. (c) Failing to provide for environmentally sound management practices in the collection, transportation, or processing of covered electronic devices;

2. (2) Class II:

   1. (a) Failing to submit a plan, study, notification, report, or other required information to DEQ, unless otherwise specified;
   2. (b) Failing to implement one or more elements of a producer responsibility program plan;
   3. (c) For a coordinating body, failing to coordinate between electronics producer responsibility organizations;
   4. (d) Violating any otherwise unclassified requirement of ORS 459A.305 to 459A.355 or related rules.
