1. (1) Permanent and Mobile structures:

   1. (a) All permanent structures and mobile facilities where the practice of massage and bodywork is routinely conducted must:

      1. (A) Be established and maintained in accordance with all local, state and federal laws, rules & regulations;

      2. (B) Obtain a facility permit to operate;

         1. (i) Notify the Board office in writing,

            1. (I) Of any change of the permitted Facility’s name, business location, operation status, ownership, email or mailing address within 30 days of change.
            2. (II) A Facility Permit Transfer Application must be submitted and approved by the Board prior to the Facility providing of massage therapy services under new ownership, under a new business or assumed business name.
         2. (ii) A permitted Facility must display its permit in a location clearly visible to anyone entering the facility;
         3. (iii) A permitted Facility must display original licenses of its LMT employee(s) in a location inside the premises, clearly visible to the general public.
         4. (iv) A permitted Facility is required to include its permit number in all massage therapy advertisements, including but not limited to: written, electronic, televised and audio advertisements, service menus, business cards, flyers, websites, and other means of promotion of the permitted Facility.

      3. (C) Facilities exempted from the permit process:

         1. (i) Clinic or facility owned or operated by a person authorized to practice a profession by a health professional regulatory board, as defined in ORS 676.160;
         2. (ii) A career school licensed under ORS 345.010 to 345.450; and
         3. (iii) Clinics of a board approved massage therapy program.

      4. (D) Provide a finished lavatory that

         1. (i) Is well maintained,
         2. (ii) Provides a system for sanitary disposal of waste products,
         3. (iii) Is capable of being fully closed and locked from the inside,
         4. (iv) Supplies hot and cold running water,
         5. (v) Is supplied with liquid soap and single use towels,
         6. (vi) Is supplied with toilet paper at each toilet;
      5. (E) Dispose of refuse sewage in a manner described by local and state law; and
      6. (F) Follow applicable laws pertaining to public spas, pools, baths and showers.

   2. (b) All treatment spaces must:

      1. (A) Provide for client privacy, both in-house and on-site;
      2. (B) Be designated as used only for massage at the time of services;
      3. (C) Provide for sufficient heating, cooling and ventilation for client comfort; and
      4. (D) Provide illumination during cleaning.

   3. (c) The facility and treatment space must be:

      1. (A) Cleaned regularly and kept free of clutter, garbage or rubbish;
      2. (B) Maintained in a sanitary manner; and
      3. (C) Maintained free from flies, insects, rodents and all other types of pests.

2. (2) Outcall/On-site. Any temporary location where the LMT conducts massage and bodywork, the LMT must provide and utilize:

   1. (a) Safe, sanitized and well-maintained equipment, tools and preparations;
   2. (b) Sanitary linen practices; and
   3. (c) Client privacy practices.
