1. (1) A caregiver registry already in operation on July 1, 2010 shall apply to the Division for a license and pay the applicable fee by August 1, 2010.
2. (2) The Division shall allow a caregiver registry already in operation on July 1, 2010, three months from its date of application before an on-site inspection is conducted, in order to allow a caregiver registry to come into compliance with these rules.
3. (3) A caregiver registry already in operation on July 1, 2010 shall conduct criminal background checks on all caregivers placed on its registry prior to July 1, 2010 if the caregiver has not had a criminal background check in the last three years.
