1. (1) An LPHA may:

   1. (a) Enforce an ordinance adopted by the local jurisdiction regulating the retail sale of tobacco products and inhalant delivery systems for purposes related to public health and safety;
   2. (b) Administer and enforce standards established by state laws or rules regarding regulating the retail sale of tobacco products and inhalant delivery systems;
   3. (c) Educate tobacco retailers on local, state, and federal laws and standards regulating the retail sale of tobacco products and inhalant delivery systems.

2. (2) If an LPHA assumes one or more of the responsibilities listed in section (1) of this rule, they:

   1. (a) May adopt a local fee to conduct these activities; and
   2. (b) Shall enter into an Intergovernmental Agreement with the Authority to ensure information sharing necessary for the effective administration and enforcement of regulations and standards regulating the retail sale of tobacco products and inhalant delivery systems.
