The Division may commence an action to enjoin the operation of an AFH pursuant to ORS 443.775(5):

1. (1) When an AFH is operated without a valid license; or
2. (2) After notice of revocation, non-renewal, or suspension has been given, a reasonable time for placement of residents in other facilities has been allowed, and such placement has not been accomplished.
