SEX OFFENDER REGISTRATION

1. (1) “Another United States court” means a federal court; military court; tribal court of a federally recognized Indian tribe; court in a state other than Oregon; or a court of the District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the Commonwealth of the Northern Mariana Islands, or the United States Virgin Islands.
2. (2) “Electronic signature” means an electronic sound, symbol or process attached to or logically associated with a record and executed or adopted by a person with the intent to sign the record.
3. (3) “Registering agency” and “registering agencies” means a local police department, county sheriff’s office, or a regional Oregon State Police office.

4. (4) “Sex offender” means a person convicted, adjudicated or found guilty of a crime:

   1. (a) That would constitute a sex crime if convicted in this state; or
   2. (b) Which the person would have to register as a sex offender in another United States court’s jurisdiction, or as required under federal law; regardless of whether the crime would constitute a sex crime in this state.
5. (5) “Sex offender web site” means an internet web site maintained by the Department that contains information about registered sex offenders.
6. (6) “Sex offender registration form” means information regarding sex offenders that is formatted, inscribed, stored and retrievable on a Department approved medium.

7. (7) “Sex offender information” includes but is not limited to:

   1. (a) Complete name(s), including but not limited to:

      1. (A) First, middle(s), and last;
      2. (B) Prefixes and suffixes;
      3. (C) Alias(es);
      4. (D) Ethnic Names; and/or
      5. (E) Tribal names
   2. (b) Date of birth
   3. (c) Driver’s license and/or State ID number with expiration date(s)
   4. (d) Social Security Number
   5. (e) SID Number
   6. (f) FBI Number
   7. (g) Fingerprints
   8. (h) Palm prints
   9. (i) Photograph
   10. (j) Race
   11. (k) Gender

   12. (l) Physical description, including but not limited to:

       1. (A) Height
       2. (B) Weight
       3. (C) Hair color
       4. (D) Eye color
       5. (E) Scars
       6. (F) Birth or other body marks
       7. (G) Tattoos, and/or
       8. (H) Other identifying characteristics
   13. (m) Emergency contact information
   14. (n) Internet identifiers, both web and application based
   15. (o) Passport number(s) and /or immigration documents and expiration dates

   16. (p) Current residential address, or

       1. (A) If no permanent physical address, then the location where the sex offender can be found on a consistent basis.
       2. (B) If planning a move, then the current and future residential address.
   17. (q) Any information concerning temporary lodging of seven days or longer.
   18. (r) Current name and address of employment, vocation, transient or day labor, and/or volunteer address where sex offender works or will work, regardless of monetary compensation, if applicable.
   19. (s) Current name and address of education institution whether public or private, including any higher education, secondary, trade, and/or professional school, where sex offender attends or will attend.
   20. (t) Professional licenses, designations, and certifications held by the sex offender.
   21. (u) Year, make, model, color, license plate number, registration number, and addresses/locations for all vehicles, including automobiles, watercrafts, and aircraft, currently owned or operated by sex offender.

   22. (v) Offenses of conviction, including:

       1. (A) Title of offense(s) or ORS number(s)
       2. (B) Year(s) of conviction.
       3. (C) Offender’s age at time of offense.
       4. (D) Victim’s age at time of offense.
       5. (E) Text of offense statute.
   23. (w) Offender level as referenced in ORS 163A.100 and 163A.105.
   24. (x) Offender status.

8. (8) “Victim” means a person, or the legal guardian of a person, who is:

   1. (a) The victim of a sex crime listed in ORS 163A.005 the commission of which resulted in a conviction, a finding of guilty except for insanity, or a finding that a youth was within the jurisdiction of the juvenile court for an act which, if committed by an adult, would constitute a sex crime; or
   2. (b) Any person who is named in a criminal complaint as a victim of a sex crime listed in ORS 163A.005 who in the course of any judicial proceeding is acknowledged by the defendant to be the victim of a sex crime listed in ORS 163A.005.
