1. (1) A Claimant who disagrees with a decision of the director regarding the entitlement to recover Escheat Property may file a request for a contested case hearing before the Office of Administrative Hearings.
2. (2) A request for a contested case hearing must be filed within 60 days of the date of the Treasurer’s decision.

3. (3) The request for a contested case hearing must:

   1. (a) Be in writing;
   2. (b) Identify the issues of law or fact being contested; and
   3. (c) Provide a summary of the evidence asserted in the petition.

   4. (d) The Claimant may file the request for contested case hearing by:

      1. (A) Emailing the request to claims@ost.state.or.us; or

      2. (B) Mailing or delivering the request to the following address:

         Oregon’s Unclaimed Property Program
         Oregon State Treasury
         867 Hawthorne Ave SE
         Salem, OR 97301-5241

4. (4) The Treasurer will refer the contested case to the Office of Administrative Hearings as provided under OAR 137-003-0515 and 137-003-0520. The administrative law judge may only issue a Proposed and Final Order.
