(1) Temporary filing, in addition to the requirements outlined in ORS 183.335(5) and (6), must include the following components:
- (a) Caption;
- (b) Agency approved date;
- (c) Effective date;
- (d) Through date;
- (e) Rule number and title;
- (f) Final rule text, which must comply with OAR 166-500-0055;
- (g) Associated statutory/other authority and statutes/other implemented, as defined in OAR 166-500-0010;
- (h) Rule summary provided for each rule; and
- (i) If applicable, a PDF of all rule attachments containing items such as charts, drawings, forms, graphs, maps, seals, tables, and other non-text information that is directly related to the rule and is not included in the rule text. See OAR 166-500-0060.
- (2) Agencies adopting or amending rules incorporating published standards by reference may omit copies of the publications if applicable, under ORS 183.355(2). Agencies must explain how the public may obtain referenced items.
- (3) An agency may file a temporary rule without first filing a notice of proposed rulemaking.
(4) When a temporary rule expires at the end of the indicated through date:
- (a) The rule language reverts to the last permanent language on file.
- (b) If a rule number is temporarily adopted and a notice of proposed rulemaking is not filed before the expiration date, the temporary rule number is no longer available for use.
