1. (1) A lease in good standing is assignable.

2. (2) To request the assignment of a lease, the lessee must submit a:

   1. (a) Notice of proposed assignment on a form provided by the department at least 60 calendar days prior to the date that the assignment is requested to occur; and

   2. (b) Non-refundable assignment processing fee payable to the department of:

      1. (A) Non-commercial use: $250.
      2. (B) Commercial use: $500.
      3. (C) Cellular communications macro cellular facility: $750.
      4. (D) Cellular communications small wireless facility: $250.
3. (3) The department may request additional information concerning the proposed assignment.
