All state-owned lands and mineral rights under the Division’s jurisdiction are available for prospecting except:

1. (1) Lands and mineral rights classified as containing commercially valuable mineral deposits; and
2. (2) Lands reserved for a Natural Area Preserve or otherwise withdrawn from exploration;
3. (3) Lands and mineral rights already subject to exclusive permit or lease. State-owned parcels not included in the State Minerals Registry but under the jurisdiction of the Division may be made available for minerals exploration by special arrangement.
