1. (1) To qualify for a State of Oregon geophysical permit or oil and gas lease, an applicant must be:

   1. (a) A citizen of the United States of legal age;
   2. (b) A partnership conducting business under an assumed business name or a corporation registered with the State Corporation Division; or
   3. (c) A domestic governmental body.
2. (2) Members of the State Land Board and employees of the Division of State Lands shall not take or hold leasehold interests in state-owned oil and gas rights.
