1. (1) In order to be eligible for an Award, the Project must:

   1. (a) Substantially contribute to the improvement, expansion or repair of the state’s or a Municipality’s infrastructure system; and
   2. (b) Be essential for the continued use or development of farm, industrial, or commercial land in Oregon.

2. (2) For development projects, allowable Project costs include the necessary and reasonable costs, as determined by the Authority, for eligible Project activities. Eligible Project activities include, but are not limited to:

   1. (a) Direct Project Management Costs;
   2. (b) Consultant services;
   3. (c) Construction;
   4. (d) Property acquisition, including easements and rights of way that are directly related to and necessary for the Project;
   5. (e) Costs incurred by the Applicant prior to the Award if such costs are allowable under the Authority’s adopted policy for reimbursement of pre-Award costs; and
   6. (f) Other costs that the Authority determines to be necessary and reasonable.

3. (3) For planning Projects, allowable Project costs include the necessary and reasonable costs, as determined by the Authority, for eligible Project activities. Eligible Project activities include but are not limited to:

   1. (a) Preliminary and final engineering activities related to a potential development project;
   2. (b) Surveys, site investigations, or environmental actions related to a potential development project;
   3. (c) Financial, technical, or other feasibility reports, studies or plans related to a potential Levee Project; and
   4. (d) Activities that the Authority determines to be necessary and reasonable in planning for a potential Levee Project.
