This section, R.L.1910, § 5615, providing that when offense either of bigamy or incest is committed in one county and the defendant is apprehended in another, the jurisdiction is in either county, was held unconstitutional in Cleveland v. State, 41 Okla. Crim. 108, 271 P. 863 (1928)
