- A. A provision of an energy storage resource agreement executed after the effective date of the Oklahoma Energy Storage Resource Safety Act that purports to waive a right or exempt a grantee from a liability or duty established under the Oklahoma Energy Storage Resource Safety Act is void and unenforceable, but the remainder of the agreement shall remain enforceable.
- B. A resource owner shall comply with the decommissioning obligations set forth in the Oklahoma Energy Storage Resource Safety Act. A landowner subject to an energy storage resource agreement is expressly authorized to bring an action in district court for injunctive relief to enforce compliance with this act.
- C. The provisions of this section are not exclusive. The remedies provided in this section are in addition to any other procedures or remedies provided by other law. Failure to comply with the Oklahoma Energy Storage Resource Safety Act does not impair the validity or enforceability of any lease, easement, mortgage, deed of trust, or other interest in real property.
