The surviving spouse of an employee killed or mortally wounded in the performance of their duties of employment shall receive benefits as provided in 74 O.S. §916.3. Surviving spouse means a person who was legally married to the employee at the time of the employee's death. The burden of proof regarding establishing and proving the existence of the marriage shall rest with the person claiming surviving spouse status.
