Permanent impoundments may be left on mining permit areas provided the impoundment is not:

1. (1) In contact with CCB.
2. (2) Impounding water of such quality that it is incompatible with intended post-placement use.
3. (3) Constructed in a manner that causes erosion.
4. (4) Resulting in diminution in quantity or quality of water received downstream off the mining permit area.
