1. (a) The Department will rely upon the violation information supplied by the applicant under Section 460:20-15-6.8 of this Subchapter, a report from AVS, and any other available information to review histories of compliance with the Act or the applicable Department regulations, and any other applicable air or water quality laws, for:

   1. (1) The applicant;
   2. (2) Its operator;
   3. (3) Operations owned or controlled by the Applicant; and
   4. (4) Operations owner or controlled by the Applicant's operator.
2. (b) The Department must conduct the review required under paragraph (a) of this section before making a permit eligibility determination under Section 460:20-15-6.6 of this Subchapter.
