The Department shall use the following criteria in reaching its decision in a petition to designate land unsuitable for surface coal mining:

1. (1) The information contained in the data base and inventory system for lands unsuitable as required in I DOM/RR Section 764.21;
2. (2) Information provided by other governmental agencies;

3. (3) The detailed statement prepared under I DOM/RR Section 764.17(e), which includes:

   1. (A) Use of existing and available information on the potential coal resources of the area;
   2. (B) The demand for coal resources;
   3. (C) The impact of such designation on the environment, economy, and the supply of coal.
4. (4) Any other relevant information submitted during the comment period.
