1. (a) The appointing authority shall use the progressive discipline phases outlined in this subchapter and may adopt other progressive discipline steps which address the specific needs of his or her agency [74:840-6.3(A)]. The appointing authority shall file a copy of any adopted progressive discipline policy, including revisions, with the Commission. Any adopted progressive discipline policy shall include a general statement certifying that the policy contains minimum requirements which:

   1. (1) ensure the consistency, evenhandedness and predictability of discipline; and
   2. (2) ensure the flexibility to vary penalties if justified.
2. (b) The appointing authority shall furnish to each employee a copy of the progressive discipline policy, including revisions, used by the agency.
