The substantiation of any of the following items related to the applicant may be, as the Board determines, the basis for the denial of or delay of licensure of the applicant.

1. (1) Lack of necessary skills and abilities to provide adequate services.
2. (2) Misrepresentation on the application or other materials submitted to the Board; or,
3. (3) A violation of the Rules of Professional Conduct delineated in Subchapter 3.
