1. (a) Calorie terms.
2. (1) "Light"
3. (A) A dog food product which bears on its label the terms "light", "lite", "low calorie", or words of similar designation shall:
4. (i) Contain no more than 3100 kcal ME/kg for products containing less than 20% moisture, no more than 2500 kcal ME/kg for products containing 20% or more but less than 65% moisture, and no more than 900 kcal ME/kg for products containing 65% or more moisture; and
5. (ii) Include on the label feeding directions which reflect a reduction in calorie intake consistent with the intended use.
6. (B) A cat food product which bears on its label the terms "light", "lite", "low calorie", or words of similar designation shall:
7. (i) Contain no more than 3250 kcal ME/kg for products containing less than 20% moisture, no more than 2650 kcal ME/kg for products containing 20 or more but less than 65% moisture, and no more than 950 kcal ME/kg for products containing 65% or more moisture; and
8. (ii) Include on the label feeding directions which reflect a reduction in Calorie intake consistent with the intended use.
9. (2) "Less" or "Reduced Calories"
10. (A) A dog or cat food product which bears on its label a claim of "less calories", "reduce calories", or words of similar designation, shall include on the label:
11. (i) The name of the product of comparison and the percentage of calorie reduction (expressed on an equal weight basis) explicitly stated and juxtaposed with the largest or most prominent use of the claim on each panel of the label where the term appears; and
12. (ii) The comparative statement printed in type of the same color and style and at least one-half the type size used in the claim; and
13. (iii) Feeding directions which reflect a reduction in calories compared to feeding directions for the product of comparison.
14. (B) A comparison between products in different categories of moisture content (i.e., less than 20%, 20% or more but less than 65%, 65% or more) is misleading.
15. (b) Fat terms.
16. (1) "Lean"
17. (A) A dog food product which bears on its label the terms "lean", "low fat", or words of similar designation shall:
18. (i) Contain no more than 9% fat for products containing less than 20% moisture, no more than 7% fat for products containing 20% or more but less than 65% moisture, and no more than 4% fat for products containing 65% or more moisture; and
19. (ii) Include on the product label in the nutrient guarantees:
20. (I) A maximum fat guarantee immediately following the minimum fat guarantee in addition to the mandatory information as specified in Regulation 35:30-27-55(a)(3); and; and
21. (II) A maximum fat guarantee which is no more than 9% fat for products containing less than 20% moisture, no more than 7% fat for products containing 20% or more but less than 65% moisture, and no more than 4% fat for products containing 65% or more moisture.
22. (B) A cat food product which bears on its label the terms "lean", "low fat", or words of similar designation shall:
23. (i) Contain a maximum percentage of fat which is no more than 10% fat for products containing less than 20% moisture, no more than 8% fat for products containing 20% or more but less than 65% moisture, and no more than 5% fat for products containing 65% or more moisture; and
24. (ii) Include on the product label in the nutrient guarantees:
25. (I) A maximum fat guarantee immediately following the minimum fat guarantee in addition to the mandatory information as specified in Regulation 35:30-27-55(a)(3); and
26. (II) A maximum fat guarantee which is no more than 10% fat for products containing less than 20% moisture, no more than 8% fat for products containing 20% or more but less than 65% moisture, and no more than 5% fat for products containing 65% or more moisture.
27. (2) "Less" or "Reduced Fat"
28. (A) A dog or cat food product which bears on its label a claim of "less fat", "reduced fat", or words of similar designation, shall include on the label:
29. (i) The name of the product of comparison and the percentage of fat reduction (expressed on an equal weight basis) explicitly stated and juxtaposed with the largest or most prominent use of the claim on each panel of the label where the term appears; and
30. (ii) The comparative statement printed in type of the same color and style and at least one-half the type size used in the claim; and
31. (iii) A maximum fat guarantee immediately following the minimum fat guarantee in addition to the mandatory guaranteed analysis information as specified in Regulation 35:30-27-55(a)(3).
32. (B) A comparison on the label between products in different categories of moisture content (i.e., less than 20%, 20% or more but less than 65%, 65% or more) is misleading.
33. (c) Carbohydrate Terms
34. (1) “Low” Carbohydrate, Dietary Starch, and Sugars Claims. A claim of “low carbohydrates,” “low dietary starch,” “low sugars” (or a combination thereof) is not allowed.
35. (2) “Less” or “Reduced” Carbohydrates, Dietary Starch, and Sugars claims.
36. (A) A dog or cat food product that bears on its label a claim of “less ” or “reduced ” (blank is to be completed by using “carbohydrates,” “dietary starch,” or “sugars”), or words of similar designation, shall include on the label:
37. (i) The name of the product of comparison and the percentage of reduction in total dietary starch plus sugars (expressed on an equal weight basis) explicitly stated and juxtaposed with the largest or most prominent use of the claim on each panel of the label on which the term appears; and
38. (ii) The comparative statement printed in type of the same color and style and not less than one-half the size used in the claim; and
39. (iii) Maximum guarantees for dietary starch and sugars as stated in Model Regulation 35:30-27-55(a)(3).
40. (B) A comparison between products in different categories of moisture content (i.e., less than 20%, 20% or more but less than 65%, 65% or more) is misleading.
