1. (a) The petition for a declaratory ruling shall be considered by the Department.
2. (b) If the Department refuses to make a ruling or begin an individual proceeding within thirty (30) days, the petition shall be deemed denied.
3. (c) Any recommendation made by the Department shall contain proposed findings of fact and conclusions of law.
4. (d) If the Department begins an individual proceeding, the petitioner shall have an opportunity to be heard.
5. (e) Any recommendation shall be considered by the Board prior to issuance of a final order on the declaratory ruling.
