In order to determine acute hospital level of care for TEFRA children:

1. (1) The child must be age 18 years or younger and expected to meet the following criteria for at least 60 days.

   1. (A) The child must need services that:

      1. (i) are ordinarily provided in a hospital setting for the care and treatment of inpatients; and
      2. (ii) are provided in a hospital that is maintained primarily for the care and treatment of patients with disorders other than mental health diagnosis.
   2. (B) The service(s) needed has been ordered by, and is provided under the direction of, a physician.
2. (2) The services needed by the child must be greater than the services provided by an ICF/IID and a nursing facility.
