- (a) The State Fire Marshal Commission shall promulgate rules allowing the use and storage of propane-fueled grills and flattop griddles and electric wood pellet grills on boat docks provided that the act of using such cooking instruments is performed within ten (10) feet of a fire extinguisher. The fire extinguisher shall be installed and maintained in accordance with the most current version of NFPA 10®. Any violations or penalties shall be assessed to the person committing acts contrary to this rule. The marina owner or operator of the marina or boat dock shall not be held liable for the actions of its tenants or others.
- (b) The allowed use of propane-fueled grills, electric wood pellet grills, and flattop griddle cooking appliances on boat docks are as follows:
- (1) Grills and/or cooking devices shall be constantly attended until the fire is extinguished. The marina owner or operator of the marina shall provide and maintain portable fire extinguishers suitable for the hazards involved within the marina in accordance with NFPA® and International Fire Code®.
- (2) The use of portable cooking equipment on combustible boat docks shall be allowed provided that such cooking equipment is located on a non-combustible surface. The surface shall extend past the appliance to catch any flaming materials that may escape. Examples of non-combustible surfaces are, but are not limited to, metal, cement board, stone/rock surface, fire retardant-treated wood, etc.
- (3) A minimum clearance of 24 inches shall be maintained horizontally and 60 inches vertically from combustibles and 10 feet from any flammable or combustible liquids and/or by manufacturer's requirements.
- (4) Persons cooking and/or grilling on a boat dock shall provide a 2A:10BC fire extinguisher to be located within ten (10) feet of any cooking and/or grilling appliance while in use.
- (5) Any and all debris (e.g., hot ashes, cinders, smoldering coals or greasy or oily materials and so forth) created by the portable cooking equipment or other portable fuel-fired appliances shall be disposed of properly and not disposed of in the water, on the marina, boat, dock, or trash receptable unless designed and approved for use with such debris. Any flammable liquids, combustible liquids, or other combustible materials shall not be in proximity to any portable cooking equipment or other portable fuel-fired appliances while that cooking equipment or appliance is in use.
- (6) Liquified Petroleum gas cooking devices having a Liquified Petroleum gas container shall have a water capacity not greater than 2-1/2 pounds [nominal 1-pound (0.454 kg) Liquified Petroleum gas capacity]. Further, any use of Liquified Petroleum gas shall be in accordance with the Oklahoma LP Gas Administration regulations
- (7) Any outdoor or open grilling and/or cooking shall be prohibited when atmospheric conditions or local circumstances make such fires hazardous or upon a burn ban issued by any governmental authority which specifically prohibits such activities.
- (8) A fire code official, peace officer, county sheriff or the marina owner or operator is authorized to order the extinguishment upon any cooking or grilling that creates or adds to a hazardous situation.
- (9) These requirements do not apply to any federally owned or federally operated property.
- (10) The specific use of any other cooking appliances, grills, open flames, solid or liquid fueled appliances or devices other than propane-fueled grills, electric wood pellet grills, and flattop griddle cooking appliances on boat docks is prohibited.
