1. (a) Generally. Any Respondent who fails to appear, after receipt of notice, may be determined to have waived the right to appear and present a defense. A Final Order may be issued by the Executive Director granting the relief requested by default.
2. (b) Tier III application. The Executive Director may enter a default judgment against any party who fails to participate in an administrative hearing on a proposed permit for a Tier III application.
