1. (a) Annually, funds for emergency shelter grant projects may become available as the result of:

   1. (1) Project cancellations;
   2. (2) Projects completed under original cost estimates;
   3. (3) Deobligated funds;
   4. (4) Funds allocated but not utilized; or,
   5. (5) Other circumstances.

2. (b) In keeping with the annual Emergency Shelter Grant Program Guidance and Application as approved by HUD, the Department shall allocate these funds, based on need

   1. (1) As to timing of expenditure;
   2. (2) Amount of funds available for re-use; and,
   3. (3) The most appropriate use of these funds.
