The following shall constitute a violation of the Minority Business Development Fund program and procedures:
- (1) Provision of false information in the request for proposal process or in projects reports; or
- (2) Failure to comply with federal or state statutes or the Department of Commerce's rules and regulations; or
- (3) significant deviation from the grant contract; or
- (4) Expenditure of funds in an unlawful manner or contractually prohibited manner; or
- (5) Fraud, waste or mismanagement of any current or prior state or federally funded contract; or
- (6) Substantial non-compliance or non-conformance with the terms of the contract.
