The Director shall provide his/her final approval required by the Act based upon:

1. (1) The eligible company's satisfaction of statutory requirements of the Act;
2. (2) The findings of the consultant's report required by the Act; and
3. (3) The application submitted to the Director under Section 11 of this administrative regulation, and written and oral communications with the eligible company.
