1. (a) Annually, funds for Small Cities community development Block grant programs may become available as the result of:

   1. (1) Project cancellations;
   2. (2) Projects completed under original cost estimates;
   3. (3) Deobligated funds;
   4. (4) Funds allocated but not utilized; or,
   5. (5) Other circumstances.

2. (b) In keeping with the annual State Plan/Final Statement as approved by HUD, the Department shall allocate these funds, based on need:

   1. (1) As to timing or expenditure;
   2. (2) Amount of funds available for re-use; and,
   3. (3) The most appropriate use of these funds.
