Any document provided to the department of children and youth under division (C) of section 5180.453 of the Revised Code remains:

1. (A) A public record under section 149.43 of the Revised Code if it was a public record under that section before being provided to the department;
2. (B) Confidential if it was confidential under any state or federal law before being provided to the department.
