1. (A) As used in this section, "medical assistance program" and "refugee medical assistance program" have the same meanings as in section 5160.01 of the Revised Code.

2. (B) The medicaid director shall establish a medicaid waiver component to provide continuous medicaid enrollment for children from birth through three years of age. A child who is determined eligible for medical assistance under Title XIX of the "Social Security Act" or child health assistance under Title XXI of the "Social Security Act" shall remain eligible for those benefits until the earlier of:

   1. (1) The end of a period, not to exceed forty-eight months, following the determination;
   2. (2) The date when the individual exceeds four years of age.

3. (C) The waiver component described in division (B) of this section does not apply to a child who is eligible for a medical assistance program on the basis of being any of the following:

   1. (1) Deemed presumptively eligible for medicaid pursuant to section 5163.101 of the Revised Code;
   2. (2) Eligible for alien emergency medical assistance, as specified in section 1903(v)(2) of the "Social Security Act," 42 U.S.C. 1396b(v)(2);
   3. (3) Eligible for the refugee medical assistance program administered pursuant to section 5160.50 of the Revised Code.
