1. (1) Preparation for a provisional certificate. To obtain a certificate to teach English, a language other than English, mathematics, a science (biology, chemistry, physics, earth science), or social studies in grades 7-12, a candidate shall meet the requirements in one of the following subparagraphs.

   1. (i) Completion of an approved program registered by the department specifically for service as a teacher of English, a language other than English, mathematics, a science (biology, chemistry, physics or earth science), or social studies in grades 7-12. An approved program is one which prepares the teacher to create a productive learning environment, plan and execute instructional activities; monitor and assess student learning; address the special developmental and educational needs of middle level and high school students; and work effectively with students from minority cultures, students of both sexes, students from homes where English is not spoken, students with handicapping conditions, and gifted and talented students. The program will assure that the candidate has completed a baccalaureate degree with a concentration in one of the liberal arts or sciences appropriate to the area of the teaching certificate and college-level study in a language other than English. The program will provide college-supervised student teaching in both the middle level and high school grades, except in those certificate titles in which instruction is provided exclusively at either the middle level (7-9) or high school (10-12) level, in which case student teaching shall be done only at the appropriate level.

   2. (ii) Alternative completion of requirements. A provisional certificate may be issued to an applicant who has completed a program which shall include the following:

      1. (a) a baccalaureate degree from a regionally accredited institution of higher education or from an institution authorized by the Board of Regents to confer degrees and whose programs are registered by the department;
      2. (b) a concentration, satisfactory to the commissioner, of 18 semester hours in professional education, which enables the teacher to create a productive learning environment, plan and execute instructional activities, and monitor and assess student learning in the middle level grades through grade 12. Teachers must be prepared to address the special developmental needs of adolescents through young adults. The concentration must prepare the teacher to work effectively with students from minority cultures, students of both sexes, students from homes where English is not spoken, students with handicapping conditions, and gifted and talented students;
      3. (c) a satisfactory concentration of 36 semester hours of college-level credit in the area in which certification is sought. For certification in a specific area of science, at least 18 semester hours of the 36-semester-hour total must be in the specific science area (biology, chemistry, physics or earth science) of the certificate. Candidates who apply for the extension of the certificate to also teach general science prior to February 2, 2004 and upon such application qualify for the extension, shall be required to complete 18 semester hours in one science and study in at least two others. Candidates who apply for such extension of a certificate on or after February 2, 2004 shall meet the requirements of Subpart 80-4 of this Part.
      4. (d) one year of college-level study or its equivalent of a language other than English; and
      5. (e) a college-supervised student teaching experience in both the middle level and high school grades or its equivalent, satisfactory to the commissioner, except in those certificate titles in which instruction is provided exclusively at either the middle level (7-9) or high school (10-12) level, in which case student teaching shall be done only at the appropriate level. One year of paid, full-time teaching experience at the level for which a certificate is sought may be substituted for college-supervised student teaching when such experience carries the recommendation of the chief school officer.
2. (2) Examination for provisional certification. Each applicant for a provisional certificate shall submit evidence of having achieved a satisfactory level of performance on the liberal arts and sciences portion of the New York State Teacher Certification Examinations and on the written assessment of teaching skills portion of the New York State Teacher Certification Examinations.

3. (3) Time validity. The provisional certificate shall be valid for five years from its effective date and is renewable subject to the approval of the commissioner based upon good cause shown as defined in section 80-1.6 of this Part. An expired provisional certificate may be renewed once for a five year term upon evidence that the holder is enrolled in a master's degree program leading to permanent certification. Notwithstanding the requirements of this paragraph, the commissioner shall not accept applications for the renewal of a provisional certificate submitted to the commissioner after February 1, 2004.

   (b) Permanent certificate.

   The requirements for the permanent certificate shall be those in effect at the time the certificate of qualification or the renewed provisional certificate is issued.

4. (1) In addition to satisfying the requirements for provisional certification, the candidate shall have satisfied the following requirements:

   1. (i) completed satisfactorily a one academic year supervised internship or two years of teaching experience in a public or nonpublic school.
   2. (ii) All candidates shall have earned a master's degree functionally related to the field of teaching service as defined by the commissioner.
5. (2) Examination for permanent certification. Each applicant for a permanent certificate shall submit evidence of having achieved a satisfactory level of performance on an examination in the area of the teaching certificate acceptable to the commissioner and on an assessment of teaching skills acceptable to the commissioner.

6. (c) Extension for teacher of a language other than English in early childhood grades through grade 3 (PreK-3) or in lower and upper elementary grades (K-6).

   1. (1) Candidates who apply for the extension for the teacher of a language other than English in the early childhood grades through grade 3 (PreK-3) or in lower and upper elementary grades (K-6) prior to February 2, 2004 and upon such application qualify for the extension, shall meet the requirements of this subdivision. Candidates who apply for such extension of a certificate on or after February 2, 2004 shall meet the requirements of Subpart 80-4 of this Part.

   2. (2) A provisional or permanent certificate for teaching a language other than English may be extended to include the teaching of a language other than English in early childhood grades through grade 3 (PreK-3) or in lower and upper elementary grades (K-6) upon completion of a 45-clock-hour program of collegiate study, acceptable to the commissioner, in the teaching of languages other than English in early childhood grades through grade 3 (PreK-3) or in lower and upper elementary grades (K-6), or such alternative preparation as may be approved by the commissioner.

      (d) Instruction in English, a language other than English, mathematics, a science and social studies in the upper elementary grades 5-6.

   3. (1) Candidates who apply for the extension for instruction in English, a language other than English, mathematics, a science and social studies in the upper elementary grades 5-6 prior to February 2, 2004 and upon such application qualify for the extension, shall meet the requirements of this subdivision. Candidates who apply for such extension of a certificate on or after February 2, 2004 shall meet the requirements of Subpart 80-4 of this Part.
   4. (2) In order to provide such instruction a teacher shall hold the appropriate certificate issued pursuant to this section and extended to include the teaching of English, a language other than English, mathematics, a science or social studies in grades five and six provided that the certificate holder has evidence of acceptable study in middle-level education including adolescent development, the application of diverse instructional strategies including interdisciplinary teaching and the teaming of students and faculty so as to maximize student learning. In the alternative, the applicant will have completed six semester hours of collegiate study in middle- level education. This study will have prepared the teacher to have a better understanding of adolescent development, the application of diverse instructional strategies including interdisciplinary teaching, and the teaming of students and faculty so as to maximize student learning.
7. (e) This section shall apply to individuals qualifying for a provisional certificate on or after September 2, 1993, and upon such application qualify for such provisional certificate, provided that the requirements of this Subpart apply to such candidates.
