1. (c) References to Part 383 in this Subpart refer to regulations to be promulgated by the department pursuant to articles 3, 27, and 29 of the Environmental Conservation Law.

(a) Purpose.

The purpose of Subpart 383-6 is to establish financial assurance requirements which will be included as a condition of a permit for a land disposal facility which is subject to Parts 382 and 383 of this Title and is located wholly or partially within the State of New York.

(b) Applicability.

The requirements of Subpart 383-6 are applicable to every applicant and every permittee of a land disposal facility.
