(a) Unless otherwise exempt or required to obtain a permit pursuant to this Part, the following facilities must register with the department as specified in this Subpart, and are subject to section 360.15 of this Title. Each facility must comply with the criteria outlined in Part 360 of this Title and the recordkeeping and reporting requirements in section 361-1.6 of this Subpart.

1. (1) Recyclables handling and recovery facilities that accept no more than 5 tons per day of source-separated, nonputrescible recyclables based on a weekly average and have residue below 15 percent of their intake based on a full year of operation.
2. (2) Recyclables handling and recovery facilities that accept more than 5 tons per day, but less than 250 tons per day of source-separated, nonputrescible recyclables based on a weekly average and have residue below 15 percent of their intake based on a full year of operation.
