1. (1) Primary control systems. Water cooled condensers and refrigerated condensers installed on the dry cleaning machines specified in subdivision (b) of this section must meet the following requirements:

   1. (i) Water cooled condensers may only be installed as the primary control system on the existing machines specified in paragraph (b)(2) of this section.

   2. (ii) Refrigerated condensers must be equipped with the following:

      1. (a) high and low pressure gauges to monitor the proper operation of the condenser during the heated and cool-down phases of the drying cycle; and

      2. (b) a drying sensor/controller designed to reduce the solvent vapor concentration by at least 90 percent by weight based upon the amount of solvent entering and exiting the control device.

         (b) Alternative solvent dry cleaning machines.

2. (1) New machine installations. Only new machines, relocated machines, or machines less than five years old and certified by the manufacturer or their representative as being in a like new condition, may be installed in any location after the effective date of this Subpart. Newly installed machines must be dry-to-dry, closed-loop machines that are equipped with a refrigerated condenser and meet the requirements of subparagraph (a)(1)(ii) of this section. Operator exhaust ventilation and emergency pressure release venting is allowed.

   1. (i) Relocated machines. Owners of permitted or registered dry cleaning facilities may relocate from the facility any alternative solvent dry cleaning machines, that are less than 10 years old and otherwise meet the requirements of this paragraph, to any facility under the same ownership if the facility meets all other applicable requirements and a new or modified air permit or registration is first obtained.
   2. (ii) Operator exhaust ventilation. After completion of the drying cycle, and for the purpose of minimizing operator exposure, drum evacuation systems may be activated to draw fresh room air into the drum and vent any residual solvent vapor to the atmosphere. Drum evacuation systems must isolate the drum from the rest of the machine prior to activation.

3. (2) Existing machine requirements. Compliant alternative solvent dry cleaning equipment installed prior to the effective date of this Subpart and listed in subparagraph (i), (ii) or (iii) of this paragraph must be operated as specified. Machines that are in need of replacement or removed from service may only be replaced with exempt equipment or a perc or alternative solvent machine allowed under this Part.

   1. (i) Washing, washing with extraction, and extraction machines may be operated until December 31, 2031. Thereafter, these washing, washing and extracting, and extracting transfer machines must be removed from service.

   2. (ii) Dryers may be operated as specified below:

      1. (a) Dryers without a primary control system may be operated until December 31, 2021. Thereafter, these uncontrolled dryers must be removed from service.
      2. (b) Solvent recovery dryers that are equipped with a water cooled condenser as the primary control system may be operated until December 31, 2026. Thereafter, these solvent recovery dryers that are equipped with a water cooled condenser must be removed from service.
      3. (c) Solvent recovery dryers that are equipped with a refrigerated condenser as the primary control system may be operated until December 31, 2031. Thereafter, these solvent recovery dryers that are equipped with a refrigerated condenser must be removed from service.
   3. (iii) Dry-to-dry, closed-loop dry cleaning machines that are equipped with a water cooled condenser or refrigerated condenser as the primary control system may be operated until in need of replacement.
