1. (1) Persons who wish to hunt wild turkey must possess a turkey permit in addition to a valid license to hunt small game.

2. (2) Persons who are authorized to hunt wildlife without a license (under section 11-0707[1][a] and [5] of the Environmental Conservation Law) must possess a turkey permit.

   (b) Special permits.

3. (1) A turkey permit is not transferable.
4. (2) A hunter may not apply for, possess and use more than one turkey permit in any one license year. A hunter who loses or accidentally destroys his/her permit may, however, apply for and be issued a duplicate permit.

5. (3) The turkey permit is valid for both the fall and subsequent spring seasons.

   (c) Season dates and boundaries.

6. (1) Fall. A permittee may hunt wild turkey only during those open seasons and in those wildlife management units (as described in section 4.1 of this Title) listed below.

7. (2) Spring. A permittee may hunt wild turkey only during those open seasons and in those wildlife management units (as described in section 4.1 of this Title) listed below.

8. (3) Spring youth hunt.

   1. (i) Season. There shall be a spring youth hunt for wild turkey. Eligible participants shall be those persons 12 through 15 years old holding a turkey permit and junior hunting license, or persons 12 through 15 years old holding a turkey permit but not required to have a hunting license pursuant to section 11-0707 of the Environmental Conservation Law. The youth hunt shall be open in Suffolk County (Wildlife Management Unit 1C) and all areas of the State in which a spring turkey hunting season is held pursuant to paragraph (2) of this subdivision, and the dates of the youth hunt shall be as follows:

      1. (a) during years in which May 1st is a Thursday, Friday, Saturday or Sunday, the spring youth hunt shall be the last full weekend (Saturday and Sunday) of April; and
      2. (b) during years in which May 1st is a Monday, Tuesday, or Wednesday, the spring youth hunt shall be the next to last full weekend of April.
   2. (ii) Supervision. Any youth participating in the spring youth hunt for wild turkey shall be accompanied by an adult as required by Environmental Conservation Law, section 11-0929. An adult who is accompanying a youth hunter pursuant to this section shall possess a valid hunting license and turkey permit. An adult who is accompanying a youth hunter may call for and otherwise assist the youth hunter, but shall not carry a firearm, crossbow, or longbow or kill a wild turkey during the youth hunt.

   3. (iii) Bag limit. A youth hunter may take one bearded turkey during the youth hunt. A turkey taken during the youth hunt shall be counted as part of the youth hunter's regular spring season bag limit.

      (d) Bag limits.

9. (1) Fall. A permittee may take:

   1. (i) one turkey of either sex during the fall season on the statewide carcass tag in any open area; and

10. (2) Spring. A permittee may take:

    1. (i) two bearded turkeys during the spring season as defined in paragraph (c)(2) of this section; however

    2. (ii) no more than one bearded turkey per day.

       (e) Shooting hours.

11. (1) Fall. A permittee may hunt turkey from sunrise until sunset.

12. (2) Spring. A permittee may hunt turkey from one-half hour before sunrise until noon.

    (f) Manner of taking.

13. (1) A person who hunts turkey must carry both his/her hunting license and his/her TURKEY PERMIT on his/her person while afield.
14. (2) A permittee may hunt turkey with a long, recurve or compound bow or crossbow.
15. (3) A permittee may hunt turkey with a shotgun or handgun loaded with shot no larger than number 2 and no smaller than number 8.
16. (4) A permittee may not take turkey with a rifle or handgun except as provided in paragraph (3) of this subdivision.
17. (5) A permittee may not hunt turkey with a dog during the spring season.
18. (6) A permittee may not hunt turkey by the aid of baiting, or on, or over any baited area.
19. (7) A permittee may not hunt turkey with the aid of an electronic calling or amplification device during an open turkey season. Further, a permittee may not use an electronic calling or amplification device to locate turkeys at any time during an open turkey season.

20. (8) A permittee may not hunt turkey with the aid of a live turkey as a decoy.

    (g) Tagging and possession.

21. (1) A permittee who takes a turkey must immediately fill out the appropriate carcass tag, cut out or mark with indelible ink the month and date of kill printed along the edge of the carcass tag and affix the carcass tag to the carcass and report as specified in section 180.10 of this Title.
22. (2) A person who possesses a turkey carcass must ensure that the carcass is properly tagged.
23. (3) The carcass tag must remain attached to the carcass until the carcass is prepared for consumption.

24. (4) A permittee may consign the turkey carcass to another person. The permittee must write his/her own name, address, hunting license number and turkey permit number, and the name and address of the consignee on a tag. This tag must be securely attached to the carcass or a portion of the carcass. The tag must remain attached until the carcass is prepared for consumption.

    (h) General provisions.

25. (1) A permittee who has taken a turkey pursuant to the provisions of this section may "call" turkey for another permittee only if he/she does not carry a bow or firearm of any kind.
26. (2) A person must comply with the general provisions of the Environmental Conservation Law, in addition to the regulations contained in this section.
