N.Y. Comp. Codes R. & Regs. tit. 22, § 1850.10
In all instances where an attorney is appointed as trustee, he/she shall not be entitled to receiving or paying commissions without prior court approval, except as provided in SCPA, sections 2308 and 2309, and he/she shall not be authorized to pay any legal fees, except as provided in SCPA, section 2111. In the event legal fees are paid pursuant to SCPA § 2111(2), the reasonableness of said legal fees are subject to review by this court.
