N.Y. Comp. Codes R. & Regs. tit. 21, § 1035.3
(a) Eligibility for paratransit services shall be limited to individuals specified in section 1035.2 of this Part who are determined to be eligible by the authority's eligibility process, which may include any or all of the following elements:
(c) If, within the time period specified below from the date of submission of a complete application, the authority has not made a determination of eligibility, the applicant shall be treated as paratransit-eligible and provided service until and unless the authority denies the application. The time periods for determining eligibility are:
(l) Decisions of eligibility appeals will be made in writing, within the time periods specified in this subdivision, that shall run from the date of receipt of the written appeal, or from the date the hearing is concluded, as applicable. The authority is not required to provide paratransit service during the period that an appeal is pending. Where an appeal has not been decided within the specified period, an individual will be entitled to eligibility from the first day after the end of the specified period until the determination of the appeal has been made.
