1. (a) Require maximum feasible efficiency in the use of water by new industrial, municipal and agricultural users throughout the basin.
2. (b) Require eventual application of those water-conserving practices or technologies that can feasibly be employed by existing water users.

3. (c) Owners of water supply systems serving the public (purveyors) seeking approval under section 3.8 of the compact for a new or an expanded water withdrawal shall include as part of the application, a water conservation plan. The plan shall describe the various programs adopted by the purveyor to achieve maximum feasible efficiency in the use of water.

   1. (1) The water conservation plan shall, at a minimum, describe the implementation of the following programs as required by the commission:

      1. (i) Source metering (Resolution No. 86-12);
      2. (ii) Service metering (Resolution No. 87-7 Revised);
      3. (iii) Leak detection and repair (Resolution No. 87-6 Revised); and
      4. (iv) Water conservation performance standards for plumbing fixtures and fittings (Resolution No. 88-2 Revision No. 2).
      5. (v) An ongoing water auditing program in accordance with section 890.8 of this Part.

   2. (2) All applications submitted after June 30, 1992 for a new or expanded water withdrawal that results in a total withdrawal equalling or exceeding an average of one million gallons of water per day shall include the following in the water conservation plan:

      1. (i) An evaluation of the feasibility of implementing a water conservation pricing structure and billing program as required in section 890.7 of this Part; and
      2. (ii) Provision of information on the availability of water-conserving devices and procedures (Resolution No. 81-9).
   3. (3) The water conservation plan shall be subject to review and approval by the designated agency in the state where the system is located. The designated state agencies are: Delaware Department of Natural Resources and Environmental Control; New Jersey Department of Environmental Protection and Energy; New York Department of Environmental Conservation; and Pennsylvania Department of Environmental Resources.
   4. (4) The Executive Director shall enter into administrative agreements with each of the designated agencies to administer and enforce the provisions of this regulation. In the absence of an administrative agreement, the commission shall administer and enforce the regulation.
   5. (5) This regulation shall be effective immediately.
