Appeal from denial of access to records.
State of New York
(a) Any person who is denied access to any record may, within 30 days of such denial, appeal the denial in writing to the records appeals officer of the corporation at the public office address of that officer. Upon receipt of an appeal, the records appeals officer shall immediately forward a copy of such appeal to the Committee on Open Government, Department of State, 162 Washington Avenue, Albany, NY 12231.
(b) The time for deciding an appeal shall commence upon receipt of a written appeal identifying:
(1) the date of the request for records;
(2) the records that were denied; and
(3) the name and return address of the appellant.
(c) The records appeals officer shall inform the appellant and the Committee on Open Government, in writing, of the corporation's determination within 10 business days of receipt of an appeal.
