1. (a) Corporation shall mean the New York State Urban Development Corporation doing business as Empire State Development.

2. (b) Distressed community shall mean a census tract, or defined portion thereof, that, according to the most recent census data available, has:

   1. (1) a poverty rate of at least 20 percent for the year to which the data relate; and
   2. (2) an unemployment rate of at least 1.25 times the statewide unemployment rate for the year to which the data relate.
3. (c) Downstate shall mean the following New York State counties, subject to ESDC Directors' approval: Bronx, Dutchess, Kings, Nassau, New York, Orange, Putnam, Queens, Richmond, Rockland, Suffolk, and Westchester.

For purposes of these regulations, the terms below will have the following meanings:
