N.Y. Comp. Codes R. & Regs. tit. 18, § 900.1 – Applicability.

(a) This Part shall apply to shelters for families as defined herein.
(b) Any person, partnership, corporation, organization, agency, governmental unit, or other entity that operates a shelter for families is subject to the jurisdiction of the Office of Temporary and Disability Assistance and must comply with these regulations.
(c) A social services district shall not be reimbursed from State or State-administered grants or funds for costs incurred for shelter and services provided by shelters for families unless such facilities:
1. (1) have been issued operating certificates by the Office of Temporary and Disability Assistance pursuant to section 900.4 of this Part, as amended;
2. (2) are operating pursuant to operational plans approved by the Office of Temporary and Disability Assistance; or
3. (3) have been operating without operating certificates or operational plans approved by the Office of Temporary and Disability Assistance, in which case the facilities must be certified within three years from the effective date of the Part.
