(a) Pursuant to section 490(3)(a)(iii) of the Vehicle and Traffic Law, a person who meets the following requirements may apply to the Department of Motor Vehicles for a non-driver’s identification card and receive such card without the payment of any fee, upon submitting the appropriate application:

1. (1) an individual who is a recipient of:

   1. (i) public assistance, as defined in section 2(19) of the Social Services Law;
   2. (ii) supplemental nutrition assistance program benefits, pursuant to section 95 of the Social Services Law; or
   3. (iii) medical assistance, as defined in section 2(38)(a) of the Social Services Law; and

2. (2) an individual who:

   1. (i) has not been issued a driver’s license;
   2. (ii) has a driver’s license which has expired; or
   3. (iii) has surrendered his or her driver’s license.
