Appeals from a presiding officer's decision or amount of the fine imposed shall be in writing and verified. The appeal must be submitted to the office of the commissioner in Albany within 30 days of the date of service of the order in person via first-class mail or electronically. Appeals may be taken only by the respondent and must specifically set forth the grounds upon which the appeal is based. The requirement of filing an appeal from a determination of a presiding officer with the commissioner before judicial review of such determination may be commenced, shall only apply if the respondent is provided with written notification as to the existence of this section with the order after hearing.
