(b) Any person failing to comply with or violating section 78.8(j) of this Part relating to permissible levels of aircraft noise when in effect shall be guilty of a violation of law, and, upon conviction, shall be fined in accordance with the following schedule:

1. (1) First violation, a fine of up to $500;
2. (2) second violation, a fine of up to $1,000;
3. (3) third violation, violation, a fine of up to $2,500; and
4. (4) each aircraft operation (a landing or a takeoff) that exceeds the permissible levels of noise contained in section 78.8(j) of this Part shall be considered as a separate violation.
