(a) Revocation or suspension issued pursuant to section 510 of the Vehicle and Traffic Law.
Upon the generation of an order of suspension or revocation of a driver's license issued pursuant to section 510 of the Vehicle and Traffic Law, the department will review the motorist's driving record to determine whether the motorist is eligible for issuance of a restricted license pursuant to the provisions of this Part. If the motorist is eligible, the order will be mailed to the motorist. If the motorist is not eligible for a restricted license, the order will be mailed to the motorist with an explanation of his/her ineligibility.
(b) Revocation pursuant to section 318 of the Vehicle and Traffic Law.
Upon the generation of an order of revocation of a driver's license issued pursuant to section 318 of the Vehicle and Traffic Law, the department will not make a determination of eligibility for a restricted license at that time, unless the revocation is based upon a conviction of a violation of section 319 of the Vehicle and Traffic Law, but will mail to the motorist the revocation order.
