If the commissioner's determination modifies the abatement period set forth in the notice of violation and order to comply, such determination shall be deemed a final order under section 27-a of the Labor Law and such employer may petition for review by the Industrial Board of Appeals pursuant to the provisions of section 101 of the Labor Law.
