N.Y. Comp. Codes R. & Regs. tit. 12, § 65.25 – Amendment of petition.

(a) A petitioner may file an amended petition without the board’s permission at any time prior to service of a response to the petition. Thereafter, a petition may only be amended with the board’s permission.
(b) Unless otherwise directed, an amended petition will be served by the board in the same manner as set forth at section 65.21 of this Part, a response to an amended petition, if any, must be made in the same manner as set forth at section 65.22 of this Part, and a reply to an answer to an amended petition, if any, must be made in the same manner as set forth at section 65.23 of this Part.
